Agent Acceptable Use Policy

 

Our collective reputation is made up from the actions we each take. This is why all RealOffice360™ users must follow the Agent Acceptable Use Policy in their use of RealOffice360™. If you violate this policy, we may suspend or terminate your account. We may also suspend or terminate accounts according to our Agent Terms of Use where we see behavior, content or other factors that poses a threat to our system.

 

Acceptable Use

We want you to use RealOffice360™ to grow your business in the best way possible. You agree that you will:

Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;

o   Provide accurate information to us and keep it updated;

o   Use your real name on your profile;

o   Comply with local real estate board rules and regulations

o   Comply with relevant industry legislation (e.g. RECA)

o   Use the Services in a honest and professional manner.

o   Comply with the Canadian Anti-Spam rules and regulations, including the requirement to obtain express consent for outbound email solicitations on your part;

o   Obtain expressed consent from Homeowner regarding referral relationships and the potential to generate a fee

o   Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements, and will indemnify HIA® for any breach of this provision.

 

Prohibited Use

Please don’t use RealOffice360™ for anything other than real estate related matters. You may not:

o   Send spam or other unwelcomed communications to others;

o   Act dishonestly or unprofessionally, including by posting inappropriate, inaccurate, or objectionable content;

o   Add content that is not intended for, or inaccurate for, a designated field (e.g. submitting a telephone number in the "title" or any other field, or including telephone numbers, email addresses, street addresses or any personally identifiable information for which there is not a field provided by RealOffice360™);

o   Create a false identity on RealOffice360™;

o   Misrepresent your current Client membership by creating false Client identities;

o   Misrepresent your affiliations with a person or entity, past or present;

o   Misrepresent your identity, including but not limited to the use of a pseudonym;

o   Create a Member profile for anyone other than yourself (a real person);

o   Invite Clients you do not know to become members;

o   Use or attempt to use another's account;

o   Harass, abuse or harm another person;

o   Scrape or copy profiles and information of others through any means (including crawlers, browser plugins and add-ons, and any other technology or manual work)

o   Act in an unlawful, libelous, abusive, obscene, discriminatory or otherwise objectionable manner

o   Disclose information that you do not have the right to disclose (such as confidential information of others;

o   Violate intellectual property rights of others, including patents, trademarks, trade secrets, copyrights or other proprietary rights;

o   Violate the intellectual property or other rights of HIA®, including, without limitation, using the word " RealOffice360™" or our logos in any business name, email, or URL except as provided in the Brand Guidelines;

o   Private message any unsolicited or unauthorized advertising to your Homeowners, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation unauthorized by HIA®;

o   Post anything that contains software viruses, worms, or any other harmful code;

o   Manipulate identifiers in order to disguise the origin of any message or post transmitted through the Services;

o   Create profiles or provide content that promotes escort services or prostitution.

o   Creating or operate a pyramid scheme, fraud or other similar practice;

o   Copy or use the information, content or data of others available on the Services (except as expressly authorized);

o   Copy or use the information, content or data on RealOffice360™ in connection with a competitive service (as determined by HIA®);

o   Copy, modify or create derivative works of RealOffice360™, the Services or any related technology (except as expressly authorized by HIA®);

o   Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology, or any part thereof;

o   Imply or state that you are affiliated with or endorsed by HIA® without our express consent (e.g., representing yourself as an accredited HIA® Advisor);

o   Rent, lease, loan, trade, sell/re-sell access to the Services or related any information or data;

o   Remove any copyright, trademark or other proprietary rights notices contained in or on our Service;

o   Remove, cover or obscure any advertisement included on the Services;

o   Collect, use, copy, or transfer any information obtained from RealOffice360™ without the consent of HIA®;

o   Share or disclose information of others without their express consent;

o   Use manual or automated software, devices, scripts robots, other means or processes to access, "scrape," "crawl" or "spider" the Services or any related data or information;

o   Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;

o   Monitor the Services' availability, performance or functionality for any competitive purpose;

o   Engage in "framing," "mirroring," or otherwise simulating the appearance or function of the Services;

o   Access the Services except through the interfaces expressly provided by HIA®, such as its Website;

o   Override any security feature of the Services;

o   Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or

o   Copy, distribute or use the information, content or data provided by HIA® in connection with a competitive service.
